NAMANKART TERMS & CONDITIONS
1. Acceptance of Terms
By accessing, browsing or purchasing through www.namankart.com, you agree to these Terms & Conditions and the policies incorporated into them.
These include, where applicable:
- Privacy Policy;
- Shipping Policy;
- Return & Refund Policy;
- Cancellation Policy;
- Payment Terms; and
- product-specific terms.
2. Legal Identity of the Seller
NamanKart is an independent e-commerce brand/platform.
The actual legal entity responsible for a particular transaction shall be identified in the relevant invoice, order confirmation or other transaction documentation.
The use of the NamanKart brand or reference to the Naman Group does not automatically make every company within the Naman Group a seller, supplier, contracting party or guarantor of every transaction.
No customer should infer contractual responsibility of another Naman Group entity merely from the existence of a common brand, website, technology platform, administrative service or business relationship.
This does not exclude any liability that applicable law places upon an entity.
3. Independent Platform and No Temple Affiliation
NamanKart is an independent e-commerce platform.
Unless expressly stated otherwise in writing, NamanKart and the Naman Group of Companies are not directly or indirectly owned, operated, managed, controlled, administered, sponsored, endorsed, appointed or officially affiliated with any temple authority, temple trust, Devasthanam, temple board, shrine, religious institution or pilgrimage authority.
NamanKart does not act as an agent, representative or spokesperson of any temple authority unless expressly established through a written agreement.
4. Temple Names and Religious Locations
Temple, deity, shrine and pilgrimage-location names may appear on the website for:
- product identification;
- sourcing context;
- geographical identification;
- traditional association;
- product description; or
- customer information.
Such references do not by themselves constitute a representation of official temple endorsement, certification, authorisation, partnership or commercial affiliation.
5. Retailer-Sourced Products
Certain products may be procured through independent retailers, suppliers or sourcing partners operating:
- at;
- near;
- around; or
- in connection with
particular temples or pilgrimage destinations.
The relevant retailer/supplier may provide information concerning the product's:
- sourcing;
- availability;
- location;
- traditional association;
- description; and
- characteristics.
NamanKart may use such information to create and maintain product listings.
The use of a temple or pilgrimage location in the product name or description should not be interpreted as meaning that the temple authority itself manufactured, packaged, sold, certified or endorsed the product unless expressly stated and supported by an appropriate basis.
6. Product Authenticity
NamanKart aims to source products through legitimate retailers, suppliers and sourcing channels.
A product being procured through an independent retailer does not by itself mean that the product is unauthentic.
Where appropriate, product descriptions may identify the sourcing location or traditional association to help customers understand the product.
NamanKart will not knowingly represent a product as officially issued, certified, authorised or directly supplied by a temple authority where there is no appropriate basis for making that representation.
7. Mandatory Retailer/Supplier Standards
Retailers and suppliers dealing with NamanKart are expected to provide accurate information regarding:
- product identity;
- material;
- quantity;
- dimensions;
- sourcing;
- applicable certifications;
- temple/location associations;
- product claims; and
- other material characteristics.
Retailers/suppliers must not falsely represent:
- temple authorisation;
- temple endorsement;
- official temple affiliation;
- certification;
- direct temple supply; or
- other official relationships.
NamanKart may request clarification or supporting information where reasonably necessary.
8. Product Page Disclosure
Where a product is associated with a particular temple or pilgrimage location, the following or substantially similar disclosure may be displayed:
Sourcing Information: This product is procured through our independent retail/sourcing partners operating at or around the relevant temple/pilgrimage location. NamanKart is an independent e-commerce platform and is not directly or indirectly affiliated with, endorsed by or operated by the relevant temple authority unless expressly stated otherwise. The location reference describes the product's sourcing context or traditional association and does not by itself constitute official temple endorsement or authorisation.
For prasad or food products:
Prasad Sourcing Information: This product is procured through independent retail/sourcing partners at or around the relevant temple/pilgrimage location. NamanKart is an independent e-commerce platform and is not a temple authority or official representative unless expressly stated otherwise. The temple/location reference describes the sourcing context of the product and does not by itself constitute official temple endorsement or commercial affiliation.
9. Product Descriptions
NamanKart makes reasonable efforts to maintain accurate product descriptions.
However, certain information may originate from retailers, suppliers, manufacturers or sourcing partners.
Customers should review the product page, specifications, photographs, quantity, dimensions, ingredients/material information and applicable instructions before ordering.
10. Natural and Handmade Variations
Minor differences may occur because of:
- handmade production;
- natural materials;
- traditional manufacturing;
- lighting;
- photography;
- screen settings; or
- normal production variations.
Such minor variations do not ordinarily constitute a defect where they do not materially alter the product.
11. Religious and Spiritual Claims
Information regarding religious or spiritual significance is provided for informational and devotional purposes.
NamanKart does not guarantee:
- financial prosperity;
- health improvement;
- healing;
- employment;
- relationship outcomes;
- removal of astrological conditions;
- fulfilment of wishes;

12. Product-Use Disclaimer
Customers are responsible for using products according to their intended purpose and applicable instructions.
Particular care should be exercised with products involving:
- fire;
- incense;
- heat;

14. Pricing

If a material pricing or technical error is identified before fulfilment, NamanKart may contact the customer or cancel the affected order.
Where payment has already been received for an order cancelled by NamanKart, the eligible amount will be refunded.
15. Platform / Convenience Fee
Where applicable, any platform, convenience or service fee will be clearly displayed before the customer completes payment.
Unless otherwise stated or legally required, such fee may be non-refundable for customer-initiated cancellations.
Any deduction will be limited to charges that were properly disclosed and are legally permissible.
16. Order Acceptance
Submitting an order constitutes a request to purchase.
An order may remain subject to:
- availability;
- payment verification;
- address verification;
- serviceability;
- fraud/security checks;
- supplier availability; and
- applicable legal requirements.
17. Order Cancellation by NamanKart
NamanKart may cancel or decline an order where reasonably necessary due to:
- product unavailability;
- material pricing error;
- inaccurate information;
- suspected fraud;
- payment irregularity;
- non-serviceable location;
- regulatory restrictions;
- product quality concerns; or
- legitimate operational reasons.
Where payment has been received, the eligible amount will be refunded.
18. Customer Cancellation
A customer may request cancellation before the order is shipped or handed over to the logistics/courier partner.
Once the order has been shipped or handed over, cancellation will generally not be available solely because the customer has changed their mind.
This is subject to the applicable Return & Refund Policy and mandatory consumer rights.
19. Refund for Pre-Shipment Cancellation
Where an eligible cancellation is accepted before shipment:
The platform/convenience/service fee will be deducted only where the fee was disclosed before payment and such deduction is legally permissible.
No refund shall be processed contrary to a mandatory legal right.
20. No Refund Solely After Shipment
Once the parcel has been shipped or handed over to the logistics partner, a refund will generally not be available merely because:
- the customer changed their mind;
- the customer no longer wants the product;
- the customer refuses delivery; or
- the customer is unavailable to receive it.
However, this does not remove remedies available for:
- damaged goods;
- defective goods;
- wrong goods;
- materially misdescribed goods;
- unsafe goods; or
- other legally recognised grounds.
21. Returns
Returns will be governed by the applicable Return & Refund Policy.
Where legally permissible, certain products may not ordinarily qualify for change-of-mind returns, including:
- perishable food;
- prasad;
- customised products;
- opened/used products;
- hygiene-sensitive products; and
- products where return is not reasonably practicable.
Mandatory statutory remedies remain unaffected.
22. Damaged/Wrong/Missing Products
Customers should report damaged, wrong, missing or materially defective shipments as soon as reasonably possible.
NamanKart may request reasonable evidence such as:
- photographs;
- packaging photographs;
- delivery documentation;
- unboxing video, where available;
- order details; and
- other relevant information.
Failure to provide requested evidence may make investigation more difficult but will not automatically extinguish any mandatory statutory right.
23. Prasad and Perishable Products
Prasad and other food products may have limited shelf life and may require specific storage conditions.
Customers should follow the applicable product instructions.
Where legally permissible, perishable products may not be eligible for change-of-mind cancellation or return after processing/shipment.
This does not affect remedies relating to products that are:
- damaged;
- spoiled;
- unsafe;
- wrong; or
- materially different from what was ordered.
24. Delivery
Delivery timelines displayed on the website or checkout are generally estimates unless expressly guaranteed.
Delivery may be affected by:
- courier delays;
- weather;
- natural disasters;
- strikes;
- government restrictions;
- transportation disruption;
- incorrect addresses;
- public emergencies;
- technical failures; or
- other circumstances beyond reasonable control.
25. Incorrect Customer Information

- PIN code; and
- other delivery information.
Additional charges may apply where permitted if re-shipment is required solely because of materially incorrect information provided by the customer.
26. Fraudulent Orders and Abuse

- fraudulent payments;
- refund abuse;
- return abuse;
- promotional abuse;
- false claims;
- identity misuse;
- repeated abusive transactions; and
- unlawful activity.
Where reasonably necessary, NamanKart may place a transaction on hold while conducting verification.
27. Force Majeure
NamanKart shall not be responsible for delays caused by circumstances beyond reasonable control, including:
- natural disasters;
- severe weather;
- war;
- civil unrest;
- government action;
- strikes;
- transport disruptions;
- telecommunications failures;
- widespread technical failures; and
- public emergencies.
Reasonable efforts will be made to restore affected services.
28. Limitation of Liability
To the maximum extent permitted by applicable law, NamanKart shall not be liable for indirect, incidental, special or consequential losses arising solely from use of the website or products, including loss of profits, goodwill, business opportunities or anticipated savings.
Where NamanKart is legally determined to be responsible for a particular order, its liability may, to the maximum extent legally permissible, be limited to the amount paid for the affected product/order.
Nothing in these Terms excludes or limits:
- mandatory consumer rights;
- liability that cannot legally be excluded;
- liability for fraud or wilful misconduct; or
- statutory remedies.
29. Third-Party Suppliers and Service Providers
NamanKart may use independent parties for:
- product sourcing;
- logistics;
- payment processing;
- technology;
- hosting;
- customer support;
- analytics; and
- communication services.
Each party may have responsibilities under its respective contractual arrangement and applicable law.
NamanKart's use of an independent service provider does not, by itself, create an agency relationship between NamanKart and that provider or any temple authority.
30. Retailer Responsibility
Where a retailer or supplier provides product information, sourcing information or other representations to NamanKart, the retailer/supplier is responsible for the accuracy of information it supplies, subject to its agreement with NamanKart and applicable law.
Retailers/suppliers must not provide knowingly false or misleading information.
NamanKart may suspend or discontinue a retailer/product where material concerns arise.
31. Intellectual Property
The NamanKart name, logo, website design, original photographs, text, graphics, videos, product descriptions and other original materials are protected by applicable intellectual-property laws.
Unauthorised reproduction or commercial use is prohibited.
32. Customer Reviews
Reviews must be genuine and must not contain:
- fabricated claims;
- unlawful content;
- threats;
- defamatory statements;
- personal information of others;
- copyrighted content without permission; or
- promotional spam.
NamanKart may moderate content in accordance with applicable law and these Terms.
33. Customer Content
Customers submitting photographs, reviews or testimonials represent that they have the necessary rights to submit the content.
Subject to applicable law and privacy requirements, customers grant NamanKart a non-exclusive licence to display and use such content for legitimate business purposes.
34. Website Misuse
Customers must not:
- hack the website;
- bypass security;
- introduce malicious code;
- impersonate others;
- conduct unlawful activities;
- interfere with website operations;
- manipulate transactions; or
- abuse returns/refunds.
35. Indemnification
To the maximum extent permitted by applicable law, a customer may be responsible for losses directly resulting from:
- fraud;
- unlawful activity;
- material breach of these Terms;
- intellectual-property infringement;
- deliberate misuse of the website; or
- materially false information supplied by the customer.
This provision does not transfer liability that legally cannot be transferred.

39. Governing Law and Jurisdiction
These Terms are governed by the laws of India.

40. Severability
